Trustees and administrators
Company records can be an asset for creditors.
Legacy Data can work with the estate as an introducer and process coordinator, subject to court approval of our engagement where required. We never take custody of the data.
The records as an estate asset
Operational records can be offered to AI training-data buyers: internal communications, SOPs, project histories, CRM records, support tickets and business documentation.
What records are worth depends on what they contain, their condition and buyer demand. After an initial review we will give you our assessment. Nothing is guaranteed.
The estate does not hand the files to us. Before any transfer, a specialist de-identification vendor engaged by the estate removes or masks direct identifiers. We never take custody of the data.
Court approval
Whether court approval is needed depends on the country, the procedure and the case. In a US bankruptcy, both our engagement and any sale outside the ordinary course need court approval, and a consumer privacy ombudsman may be appointed.
Where approval is required, the sale can be put to the court in the usual way. We do not say that approval will be given.
The estate's own lawyer leads the court process. We do not give legal advice.
Disclosure of fees
Sellers pay us no fee. Buyers pay us separately, and we take no share of the amount paid to you. We disclose how buyers pay us before you sign our agreement, and how much, once known, before you sign with a buyer.
For bankruptcy estates and other court-supervised sales, fees are also disclosed in court filings as required.
Process
How a matter runs
The process follows four steps. The person with authority approves every buyer, and no records are transferred at the introductory call.
- 01
Introductory call
We review what the company holds, who controls it, and whether a further step is appropriate. Please do not send files. If the matter proceeds, we sign a confidentiality agreement before detailed discussions.
- 02
Authority and agreement
We ask for evidence of who can approve the deal. In an operating company, that is usually the board or an officer it has authorised. In a closure or court process, it may be a liquidator, trustee, administrator, receiver, assignee or secured lender, and court approval may be needed. You sign our agreement. Only then do we describe the records to AI training-data buyers, and you can say no to any buyer.
- 03
Identifiers removed, contract agreed
Before any transfer, a specialist de-identification vendor engaged by the company removes or masks names, contact details, credentials and other direct identifiers. The buyer contract sets use restrictions and bans re-identification. We never take custody of the data.
- 04
You decide
You can refuse any buyer. If you approve a deal, payment is made on the terms of the buyer contract. If the company is still operating, it may be able to keep using its records, if the buyer agrees to a non-exclusive licence.
Privacy, legal and security
Exclusions and limitations
How records are handled, who removes personal data, and the limits of our role. We do not display third-party certification marks and make no claim to any certification.
- We never take custody of your data. You (or your administrator) export it with your own admin tools, such as your workspace owner's export, under a written scope, and transfer it directly to the vendor or buyer.
- Before any buyer is approached, we ask for evidence of who has legal authority to sell, such as board approval, an assignment, a court order or security documents.
- We help identify which customer contracts, employee notices, platform terms and consents may affect the deal, and flag issues for you and your lawyers. The rights holder makes the final decision and gives the warranties to the buyer.
- Before any transfer, a specialist de-identification vendor engaged by the company removes or masks names, contact details, credentials and other direct identifiers. De-identification reduces, but cannot completely eliminate, the risk that individuals could be re-identified, so buyer contracts also prohibit re-identification.
- Health records, children's data, HR, payroll and compensation records, credentials, client-held material and privileged material are never offered. Personal data of people in the EU, EEA, UK or Switzerland is left out by default. It is included only if the rights holder chooses to include it after advice from its own local lawyers, completes the legal steps those laws require first, and we agree to offer it.
- We structure deals with GDPR, UK GDPR and US state privacy laws such as the CCPA in mind. Each seller and buyer remains responsible for its own legal compliance.
- We sign a confidentiality agreement with you before detailed discussions. Until you approve a buyer in writing, we share only a description that does not name the company, and we ask buyers to keep it confidential. Any samples go, once de-identified, from your de-identification vendor directly to a buyer you have approved, never to us.
- Before introducing a buyer, we review who they are and how they intend to use the data, and we require written use restrictions in the buyer contract. We cannot control or guarantee a buyer's conduct after transfer.
- We delete the information you submit through this site on request (see our Privacy Policy). For data transferred in a deal, deletion and retention terms are set in the buyer contract; we will pass on deletion requests to the buyer, but the buyer controls its own systems.
- You pay us no fee. We are paid only by buyers, and we disclose in writing how any buyer-side fee is calculated before you sign our agreement, and its amount, once known, before you sign with a buyer.
- We are not a law firm, broker-dealer, investment adviser or tax adviser. You should get independent legal and tax advice.
